Synopsis
A construction contract is a legal document, usually between a builder and an owner, that provides specific amount of compensation for completion of a construction project. There are many (easily 7 to 8) different types of construction contracts and they mainly differ in the manner and procedure in which the compensations are being awarded or distributed, any preferred risk distribution and also sometimes different scope of works.


Normally, there are three main parties involved in a construction contract: the owner, the contractor and the designer. The manner in which the three parties are involved depends on the type of contract and project. It is therefore crucial for a project lead consultant or a Client to scrutinize and decide on the most appropriate type of contract suiting a particular project or work.

The roles and responsibilities of the parties involved must be clearly defined and well understood in order that the administration of the contract can be carried out smoothly, the interests of all parties fairly guarded and the project can be completed on time and within budget.


This talk will provide the audience an opportunity to learn the different types of contracts, their different characteristics and applications. They will also be briefed on the definitions and interpretation of the various clauses of the conditions of contracts, such as Engineer’s Instruction (EI), Contractor’s Design, Performance Security, Site Administration, Insurances, Extension of Time, Liquidated Damages, Lump Sum and Remeasured Works, Variations, Prime Cost and Provisional Sum, Dispute and Termination, Mediation, Adjudication, Arbitration and Litigation etc.

The Speaker will also go through with the audience on the importance of the roles and responsibilities of the parties involved in the contract. He will, through his vast experience in large scale design and build projects, share with the audience on issues and complications that can arise before, during and after the implementation of the contract and how these can be overcome.

 

Biodata of Speaker
Dato’ Ir. Lim Kok Khong graduated with BE(Hons) degree in Civil Engineering from University of Malaya in 1988. He is a Fellow Member of IEM, an Honorary Fellow Member of ASEAN Federation of Engineering Organisations (AFEO), Associate of the Chartered Institute of Arbitrators (ACIArb), registered APEC Engineer, EMF International Engineer Register (IntPE(MY)), Green Building Index Facilitator (GBIF) and a PEPC with BEM.

Dato’ Ir. Lim is also actively involved in social responsibilities. Some of the key responsibilities include the Governor of The St. Christopher’s International School Penang, Panel member of Engineering Accreditation Council (EAC), Past Chairman of IEM Penang Branch, Member of the Penang Services Advisory Panel, Penang Hill Land Development Technical Advisory Panel, Penang Tech Centre Advisory and Penang Hill Council Technical Advisory Panel.

Dato’ Ir. Lim has more than 30 years of working experience as an engineering consultant and is currently the Managing Director of M.E.I. Project Engineers Sdn. Bhd. He has played a significant role in the organization’s growth and in obtaining its ISO 9001 certification. His expertise includes project design, management and contract administration, especially on large scale international design and build contracts. The company has completed for over 250 projects throughout Malaysia and the ASEAN Region under the leadership of Dato’ Ir. Lim. Amongst notable projects are Stevian Biotechnology Corporation, Negeri Sembilan, AUO SunPower Sdn. Bhd., Melaka (the world’s highest efficiency solar panel plant), The Hershey Confectionary Facilities with GBI Gold Certification, Bosch Facilities in Malaysia and Ambu Medical Devices Manufacturing Facilities.

The company has over the years won many engineering awards, among these are The Malaysian Construction Industry Excellence Award, The Institution of Engineers Malaysia Outstanding Engineering Achievement Award and The ASEAN Outstanding Engineering Achievement Award (AFEO).
