Understanding Causation & Negligence

in Law of Tort in Construction Industry

 

Synopsis

Causation is common to all 3 branches of torts including negligence. For a causation to be established in court, first, a tort must be the direct cause of an injury. Secondly, the plaintiffs must establish "proximate cause" of the injury evaluated in terms of foreseeability. These lay the requisites for the establishment of duty of care to prove negligence, without which at the point of breach, the plaintiff will not recover damages for the pecuniary losses sustained.

In this session, Dr Zul will explain on causation, negligence and duty of care with real-life court cases such as Donoghue vs Stevenson, Home Office v Dorset Yacht Co Ltd, McKew v Holland, Spartan Steel & Alloys Ltd vs Martin & Co (Contractors) Ltd, Cattle vs Stockton Waterworks Co., Murphy v Brentwood District Council, Hedley Byrne & Co Ltd vs Heller & Partners Ltd, Yong & Co vs Wee Hood Teck Development Corp., Uda Holdings Bhd vs Koperasi Pasaraya Malaysia Bhd etc.

 

About the Speaker:

Dr Zul Zakiyuddin Ahmad Rashid holds a Bachelor of Laws (LL.B) (Hons), Master of Comparative Laws (MCL) and Doctor of Philosophy (PhD) degrees, specializing in legal issues and Built Environment. He completed his legal training and later expanded his work experience in various companies and firms, including construction-related companies and mining.

Dr Zul Zakiyuddin joined the academic world as a Senior Lecturer at the School of Housing, Building and Planning (HBP) Universiti Sains Malaysia. He is now the Chair of Construction Industry Law Centre (CILC). He is also empanelled as AIAC Adjudicator and Mediator. He also serves as community mediator with Penang JP Mediation bureau.  In addition to daily routine as an academic, he contributes to the community's social development through various social activities.
